1. AUTHORIZATION. By clicking the "Submit" button, you authorize CLD Financial, LLC ("CLD") or its representatives to contact you via the telephone or email contact information you have provided in this form for purposes of fulfilling this inquiry about commercial mortgage financing (even if you have previously registered on a do-not-call registry). You are also stating that you are either the direct borrower or an authorized representative of the borrower and that the information submitted in the Commercial Loan Quote Request form is both true and correct to the best of your knowledge. You release and indemnify CLD, its owners, officers, employees, agents and representatives, as well as any party supplying such records and information to CLD, from any liability with respect to requesting, obtaining and/or supplying such records and other information on the applicant.

2. NON-CIRCUMVENTION. By clicking the "Submit" button, Borrower agrees and covenants that he/she/it will not directly, indirectly, or in conjunction with any other person, company, partnership, corporation, or other entity, apply to the lender(s) to which CLD has submitted the Borrower’s loan/line of credit request and put Borrower in contact with except through CLD and its exclusive agent(s.) in the event that such circumvention shall occur, the Borrower shall be liable to CLD for its potential income loss.

3. INABILITY TO SECURE FINANCING. If financing cannot be secured by CLD on behalf of Borrower, CLD’s sole obligation shall be to advise Borrower that such financing cannot be secured.
